    Terms And Conditions For WaterCelebration.us

    GENERAL

    WaterCelebration (WaterCelebration) provides information and services through its web sites, programs and computer servers, including but not limited to visiting and shopping, education concerning air quality, blog postings, and forums. (All such services are referred to collectively herein as "WaterCelebration.us.")

    By accessing or using WaterCelebration.us, you are a "user" and you accept and agree to the terms below (the "Terms And Conditions" or "TAC") as a legal contract between you and WaterCelebration. The TAC include and incorporate additional terms ("guidelines") applicable to particular categories or services available on WaterCelebration.us as set forth to users upon access to such categories or services. WaterCelebration may post changes to the TAC at any time, and any such changes will be applicable to all subsequent access to or use of WaterCelebration.us.

    WaterCelebration.us has the right, but not the obligation, to moderate content posted to, stored on, or transmitted via WaterCelebration.us by any user or third-party.

    WaterCelebration.us has the right to enforce the TAC by any means deemed appropriate by WaterCelebration.

    User content prohibited on WaterCelebration.us includes, but is not limited to:

    • Offensive content (including, without limitation, libelous, defamatory, threatening, false, obscene, indecent, lewd, pornographic, violent, abusive, threatening, harassing, discriminatory, in violation of the law, harmful to children, or hateful)
    • Content in facilitation of the creation, advertising, distribution, provision or receipt of illegal goods or services
    • Content that discloses another's personal, confidential or proprietary information
    • False or fraudulent content (including but not limited to false, fraudulent or misleading responses to postings submitted to WaterCelebration.us)
    • Any software or other materials which contain a virus, worm, Trojan horse, malware, spyware, or other malicious software
    • Content that offers, promotes, advertises or provides links to unsolicited products or services

    USE LICENSE

    Permission is granted to temporarily download one copy of the information on WaterCelebration.us for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

    • Modify or copy the materials.
    • Use the materials for any commercial purpose, or for any public display (commercial or non-commercial).
    • Attempt to decompile or reverse engineer any software contained on WaterCelebration.us
    • Remove any copyright or other proprietary notations from the materials.

    This license shall automatically terminate if you violate any of these restrictions and may be terminated by WaterCelebration at any time.     WaterCelebration does not allow framing of WaterCelebration.us.

    When you use WaterCelebration.us, or send any electronic communications (not limited to calls, emails, text messages, direct messages, whatsapp messages or via any of our social media channels etc) to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site or through the other WaterCelebration channels. WaterCelebration does sell products for children, but it sells them to adults, who can purchase with a credit card or other permitted payment method. WaterCelebration reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.

    You hereby release WaterCelebration and each of the WaterCelebration representatives, and their respective subsidiaries, affiliates, successors, predecessors, assigns, heirs, service providers and suppliers, from all claims, demands and damages of every kind and nature, known and unknown, direct and indirect, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to WaterCelebration.us or content accessed through WaterCelebration.us, or any interactions with others arising out of or related to WaterCelebration.us or content accessed through WaterCelebration.us, and you expressly waive the provisions of §1542 of the California Civil Code, which provides: A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR. In addition, you hereby knowingly and voluntarily waive any protection that may exist under any comparable or similar statutes and/or principles of common law applicable in states other than New York as it pertains to the enforcement of the release in this section.

    ARBITRATION AGREEMENT

    You agree that any dispute, claim or controversy arising out of or relating in any way to WaterCelebration.us service, including the web site, user interfaces, these Terms And Conditions and this Arbitration Agreement, shall be determined by binding arbitration instead of in courts of general jurisdiction.

    Any such arbitration will be governed by the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes (collectively, "AAA Rules") of the American Arbitration Association ("AAA"), as modified by this Agreement, and will be administered by the AAA. The AAA Rules and Forms are available online at www.adr.org, by calling the AAA at 1-800-778-7879, or by writing to the Notice Address.

    REVISIONS AND ERRATA

    The content on WaterCelebration.us could include technical, typographical, photographic, or other errors. WaterCelebration does not warrant that any of the materials on its web site are accurate, complete, or current.

    WaterCelebration may make changes to the materials contained on its web site at any time without notice. WaterCelebration does not, however, make any commitment to update the materials.

    WaterCelebration has not reviewed the sites that link to WaterCelebration.us and is not responsible for the contents of any such linking site. The inclusion of any link does not imply endorsement by WaterCelebration of the linking site.

    These Terms And Conditions shall be governed by and construed in accordance with the laws of the state of New York, USA, without regard to conflict of laws provisions. If any provision or provisions of these terms shall be held to be invalid, illegal, unenforceable or in conflict with the law of any jurisdiction, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby, and shall remain in full force and effect.

    HOW TO SERVE A SUBPOENA

    If you have a subpoena to serve on WaterCelebration, please note that WaterCelebration does not accept service via e-mail or fax and will not respond to the subpoena. All subpoenas must be properly served on WaterCelebration, preferably by mailing the subpoena to our address above.

    Please note also that providing detailed and accurate information at the outset will facilitate efficient processing of your request. That information will include, for example, e-mail and/or credit card number used to make purchases for retail purchase information; the name, e-mail, and physical address of a seller for seller information; and IP address and complete time stamp for AWS information.

The TAC do not authorize you to use "WaterCelebration.us," WaterCelebration or any similar or related marks for any use pertaining to sports analytics, social networks, online forums, online communication services or any similar or related use, or any other use that is likely to cause confusion on the part of, to cause mistake by, or to deceive the public as to any affiliation, connection, association, origin, sponsorship, approval or endorsement by, or with WaterCelebration.

    NOTICE AND PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT INFRINGEMENT
